The Housing Authority of the Sac and Fox Nation was approved on January 19, 1993, by the Department of Housing and Urban Development (HUD).

This “approval” allowed the Sac and Fox Nation to receive Federal funds.  With the reception of these Federal funds, there are “restrictions” that are to be complied with set forth by the Federal Government.

The Tribally Designated Housing Entity (TDHE) is the Housing Authority of the Sac and Fox Nation (HASFN). Housing Commissioners are appointed by the Business Committee to be the “governing body” of the HASFN.

The regulations that are to be followed by Housing Authorities are set forth at 24 CFR Part 1000 of the Native American Housing Assistance and Self Determination Act (NAHASDA).

NAHASDA is defined as The Native American Housing Assistance and Self Determination Act of 1996 (NAHASDA). This program replaced the 1937 Act funding program through Housing Authorities throughout the Nation and allowed Housing Authorities to be more innovated with their funding, which is comprised of several different components pertaining to individual tribes throughout the Nation. Housing Authorities are under NAHASDA regulations; they now have the luxury of utilizing their funds as a leveraging tool in order to obtain more needed funding.

Per Section One of the Sac and Fox Housing Authority Act of 1993:

Notes to Legislative History: The first tribal legislation concerning the Sac and Fox Housing Authority appears to be Resolution SF-66-4 which authorizes the Sac and Fox Nation, then known as the Sac and Fox Tribe of Indians of Oklahoma to operate a Housing Authority, and essentially adopted the provisions of the Oklahoma Housing Act, as Tribal law. On January 21, 1983, the Business Committee adopted Public Law No. SF-83-26 adopting the Sac and Fox Housing Authority Act. This Act was subsequently amended several times including Public Law No. SF-86-61, July 19, 1986; Public Law No. SF-86-62, July 19, 1986; Public Law No. SF-86-63, July 19, 1986; Public Law No. Sf-87-76, July 17, 1987; and Public Law No. SF-88-60, January 23, 1988. On July 24, 1987, the Sac and Fox Tribe ratified a new Constitution, and once again became known as the Sac and Fox Nation. The Assistant Secretary of the United States Department of Housing and Urban Development approved the Sac and Fox Housing Act as amended on January 19, 1993, with the understanding that several minor changes previously agreed to would be incorporated therein. This Act was adopted as positive law in order to consolidate the approved amendments to the original Act, and includes all the changes and provisions approved by the Assistant Secretary.
